booked by the Customer from the Company through the Online Booking<\/span>
System in this Website;<\/span>
\u201cCompany\u201d or \u201c[\u25cf]\u201d shall mean [\u25cf];<\/span>
\u201cCustomer\u201d shall mean the Party who uses this Website and\/or makes a<\/span>
Booking with the Company;<\/span>
\u201cMinor\u201d shall mean any person under the age of 18 years old;<\/span>
\u201cOnline Booking System\u201d shall mean the zoom online booking system\u00a0in this Website;<\/span>
\u201cParties\u201d shall mean the Company and the Customer and \u201cParty\u201d shall mean<\/span>
either of them;<\/span>
\u201cServices\u201d shall mean the [\u201cOnline Reading Program\/ Online and Offline<\/span>
Consultation Service\/ Book Purchases\/Zoom lessons\u201d] offered from time to time by the<\/span>
Company in the Website;<\/span>
\u201cSession\u201d shall mean the session of the Services offered by the Company in this<\/span>
Website;<\/span>
\u201cWebsite\u201d shall mean [\u25cf]<\/span><\/p>

2. General<\/span>
2.1 The Terms may change from time-to-time. The Company reserves the sole right<\/span>
to amend or delete any of the Terms at any time without notice to the Customer<\/span>
in accordance with its updated polices. Therefore, the Customer should read<\/span>
and review these terms carefully and periodically.<\/span>
2.2 By using the Website and\/or making a Booking or Purchase with the Company,<\/span>
the Customer is deemed to have read and accepted the Terms.<\/span><\/p>

3. Application<\/span>
3.1 The Terms shall apply to the Website and the Services displayed thereon and\/or<\/span>
booked through the Company.<\/span>
3.2 The Terms shall apply to every Booking unless the Company notifies the<\/span>
Customer in writing to the contrary. In the event of conflict between the Terms<\/span>
and any terms or conditions of the Customer, then these Terms will prevail.<\/span><\/p>

4. Setting up a Membership Account<\/span>
4.1 A Customer who wishes to make a Booking must set up a membership account<\/span>
with the Company through this Website.<\/span>
4.2 In setting up the membership account, the Customer undertakes to provide<\/span>
information which is true, accurate, not false or misleading and to immediately<\/span>
notify the Company of any changes which may be relevant to the Customer<\/span>
and\/or any Booking. The Customer also undertakes to maintain up-to-date and<\/span>
current details of its membership account with the Company.<\/span>
4.3 All relevant communications relating to a Booking will be sent to the Customer<\/span>
via the email address provided by the Customer to the Company in his\/her<\/span>
membership account. Therefore, the Customer must ensure that the email<\/span>
address provided in his\/her registration and Booking is valid, current and will be<\/span>
used for receiving communications from the Company.<\/span>
4.4 The Customer shall not share any of the details relating to his\/her membership<\/span>
account to any third parties, including but not limited to his\/her password, or<\/span>
any other relevant log-in data.<\/span>
4.5 Any information received by the Company or any act taken through the use of<\/span>
the Customer\u2019s membership account is presumed to have been acted or provided<\/span>
with the authority of the Customer associated with that membership account. In<\/span>
the event that the Customer is aware that his\/her membership account is being<\/span>
used by an unauthorised person, the Customer shall notify the Company of such<\/span>
unauthorised use immediately. The Company shall not be liable for any loss or<\/span>
damage arising out of or in relation to the unauthorised use of a Customer\u2019s<\/span>
membership account.<\/span><\/p>

5. Making a Booking via the Online Booking System<\/span>
5.1 A Customer who has set up a membership account with the Company may<\/span>
make a Booking through the Online Booking System.<\/span>
5.2 When making a Booking through the Online Booking System, a Customer will<\/span>
be required to provide:-<\/span>
5.2.1 The choice of the Services which the Customer would like to purchase;<\/span><\/p>

5.2.2 The choice of the Session which the Customer would like to book;<\/span>
5.2.3 The number of Minors whom the Customer is booking for; and<\/span>
5.2.4 The name, age and gender of such Minor(s).<\/span>
5.3 Customers making a Booking through the Online Booking System may choose<\/span>
any Session as early as 6 months in advance. If a Customer would like to make<\/span>
a Booking in advance which exceeds such period, please contact the Company<\/span>
at [email] or [telephone].<\/span>
5.4 All Sessions are subject to availability.<\/span><\/p>

6. Price and Form of Payment<\/span>
6.1 The fees for the Services offered on the Website are listed in Hong Kong<\/span>
dollars.<\/span>
6.2 The fees for the Services purchased shall be prepaid in full by the Customer via<\/span>
Paypal ( info@hkcqcenter.org ) or HSBC Payme when the Customer makes a<\/span>
Booking through the Online Booking System.<\/span>
6.3 The Customer acknowledges that the credit card details submitted by the<\/span>
Customer to the Company through the Online Booking System will be provided<\/span>
to the Company\u2019s agent for the purposes of processing the payment.<\/span><\/p>

7. Cancellation and Refund of Booking or Purchase<\/span>
7.1 Save as provided in Clauses 7.3 and 9 of these Terms, a Consultation Booking \/<\/span>
Online Reading Program\/ Purchase may not be cancelled by the Customer and<\/span>
all fees for Services paid by the Customer are non-refundable.<\/span>
7.2 The Company reserves the right to cancel a Booking if the book chosen is no<\/span>
longer in publication.<\/span>
7.3 Should any Booking\/Session be cancelled in accordance with Clause 7.2 above,<\/span>
the Company will endeavour to notify the Customer not later than [24] hours<\/span>
prior to the commencement time of such Session.<\/span>
7.4 In the event that a Customer\u2019s Booking is cancelled under Clause 7.2 of these<\/span>
Terms, the Customer would have the option to:-<\/span>
(a) A refund of the fees for the cancelled Booking; or<\/span>
(b) To change the Session of a Booking,<\/span>
provided that the above option shall be exercised within 3 days of the cancelled<\/span>
Booking. If such option is not exercised within 3 days, the Customer is deemed<\/span><\/p>

to have forfeited the option and the Customer shall not be entitled to any refund<\/span>
or change of Booking.<\/span>
7.5 If the Customer elects to change a Booking under Clause 7.4(b) above, such<\/span>
Booking shall be changed to a Session not exceeding 1 month from the date of<\/span>
the original Session booked.<\/span><\/p>

8. Change of Booking<\/span>
8.1 Save as provided in Clause 9 of these Terms, a Customer may not change the<\/span>
Session of a Booking if such request is made less than 72 hours prior to the<\/span>
commencement time of the Session booked by such Customer.<\/span>
8.2 If for any reason, a Customer would like to change the Session booked with the<\/span>
Company, such Booking may only be changed if the request is made no later<\/span>
than 72 hours before the commencement time of the Session booked by such<\/span>
Customer.<\/span>
8.3 A Customer may change the Session of each Booking through the Online<\/span>
Booking System ONCE only.<\/span>
8.4 Save for any special circumstances which should be communicated to the<\/span>
Company no later than 72 hours before the commencement time of the Session<\/span>
changed under Clause 8.3, no Booking may be further changed and the<\/span>
Customer will be deemed to have forfeited his\/her fees if the Minor(s) whom<\/span>
they represent are unable to attend the Session. Whether a booking may be<\/span>
further changed under this Clause 8.4 is solely at the discretion of the Company.<\/span><\/p>

9. Arrangements on Adverse Weather Conditions<\/span>
9.1 In the event that the Typhoon Signal No. 3 or lower is being hoisted by the<\/span>
Hong Kong Observatory, all Bookings\/Sessions for such day will continue to<\/span>
take place.<\/span>
9.2 In the event that the Hong Kong Observatory announces that the Typhoon<\/span>
Signal No.8 or above shall be hoisted within the next 2 hours, all remaining<\/span>
Bookings\/Sessions for such day will be cancelled.<\/span>
9.3 In the event that the Typhoon Signal No. 8 or Black Rainstorm Signal is hoisted<\/span>
at 8:00am by the Hong Kong Observatory, all Bookings\/Sessions for such day<\/span>
will be cancelled.<\/span>
9.4 In the event that a Customer\u2019s Booking is cancelled under Clause 9.2 and 9.3 of<\/span>
these Terms, the Customer would have the option to:-<\/span>
(c) A refund of the fees for the cancelled Booking; or<\/span>
(d) To change the Session of a Booking,<\/span><\/p>

provided that the above option shall be exercised within 3 days of the cancelled<\/span>
Booking. If such option is not exercised within 3 days, the Customer is deemed<\/span>
to have forfeited the option and the Customer shall not be entitled to any refund<\/span>
or change of Booking.<\/span>
9.5 If the Customer elects to change a Booking under Clause 9.4(b) above, such<\/span>
Booking shall be changed to a Session not exceeding 1 month from the date of<\/span>
the original Session booked.<\/span><\/p>

10. Representation and Warranties by the Customer<\/span>
10.1 By making a Booking, the Customer represents and warrants that he\/she is the<\/span>
parent or guardian of the relevant Minor or has express authority from the<\/span>
relevant Minor\u2019s guardian or parent to represent the Minor in enrolling and<\/span>
permitting the Minor to participate in the Services provided by the Company.<\/span>
10.2 The Customer represents and warrants that all details and information<\/span>
maintained in its membership account or Booking are up-to-date, true, valid and<\/span>
not misleading.<\/span><\/p>

11. Limitation of liability<\/span>
11.1 The Company does not warrant that the functionality of the Website or the<\/span>
Website of any third party to which this Website is linked (if any) will be<\/span>
uninterrupted or error-free, free of viruses or other harmful components, or that<\/span>
defects will be corrected.<\/span>
11.2 Under no circumstances will the Company be liable for any direct or indirect<\/span>
damages of any kind, arising from the Customer\u2018s use of this Website, including<\/span>
but not limited to, computer viruses and\/or unavailable or interrupted network<\/span>
connections. If the Customer is dissatisfied with the Website, the Website<\/span>
content, or these Terms, the Customer\u2019s sole and exclusive remedy is to<\/span>
discontinue using the Website.<\/span>
11.3 In the unlikely event of an accident, or loss or damage to the Customer or any<\/span>
Minor whom such Customer represents (under Clause 10.1 of the Terms) during<\/span>
their participation of the Services, the Company shall not be liable for any direct<\/span>
or indirect loss, damage or injury arising from or in connection with the<\/span>
Services (except in instances of death or personal injury caused by the<\/span>
Company\u2019s negligence) and the Customer (on its own behalf and on behalf of<\/span>
the relevant Minor to which he\/she represents) hereby waives all and any claims<\/span>
against the Company in this respect.<\/span><\/p>

12. Indemnity<\/span>
12.1 The Customer shall indemnify, defend and hold harmless the Company, its<\/span>
directors and officers from and against any and all injuries, damages, losses,<\/span>
liabilities, claims, judgments and settlements, including all reasonable costs,<\/span>
expenses and legal fees arising from or related to any breach by the Customer of<\/span>
these Terms, the Customer\u2019s negligent or willful act or omission while using<\/span><\/p>

this Website, or the Customer\u2019s infringement of the intellectual property rights<\/span>
of the Company or any third party content provider of the Website.<\/span><\/p>

13. Intellectual Property rights of the Company<\/span>
13.1 This Website contains intellectual property rights owned by the Company. All<\/span>
logos, images, books content, films and texts cannot be used without the<\/span>
Company\u2019s prior written consent.<\/span><\/p>

14. Data Protection<\/span>
14.1 Customer\u2019s data is processed in accordance with the Hong Kong Personal Data<\/span>
(Privacy) Ordinance (Cap. 486 of the Laws of Hong Kong). Details on the<\/span>

15. Invalidity<\/span>
15.1 If any one or more of the provisions of the Terms are found by any competent<\/span>
authority to be void or unenforceable, such provisions shall be deemed to be<\/span>
deleted from the Terms and the remaining provisions of the Terms shall<\/span>
continue in full force and effect.<\/span><\/p>

16. Applicable Law<\/span>
16.1 These Terms and any Booking under these Terms are governed by and shall be<\/span>
construed in accordance with the laws of Hong Kong and the courts of Hong<\/span>
Kong shall have non-exclusive jurisdiction to deal with any dispute or claim<\/span>
arising out of or in connection with any Booking or these Terms.<\/span><\/p>

17. Chinese Translation<\/span>
17.1 These Terms have been translated into Chinese. If there is any inconsistency or<\/span>
discrepancy between the English version and the Chinese version, the English<\/span>
version shall prevail.<\/span><\/p>

4.2 \u7576\u8a2d\u7acb\u6703\u54e1\u5e33\u865f\u6642\uff0c\u9867\u5ba2\u9700\u78ba\u4fdd\u63d0\u4f9b\u7684\u8cc7\u6599\u662f\u771f\u5be6\u3001\u6e96\u78ba\u3001\u975e\u932f\u8aa4\u6216\u8aa4\u5c0e\uff0c<\/span><\/p>
